8. Lawful Bases for Processing

We process personal data only where we have an appropriate lawful basis under applicable data-protection law.

Depending on the circumstances, the lawful basis may include:

Performance of a Contract

We may process information because it is necessary to enter into or perform a contract with you.

For example, we need certain information to:

  • Process your Order;
  • Deliver your Product;
  • Issue your License;
  • Maintain access to your purchase;
  • Respond to a refund request; or
  • Provide customer support relating to your transaction.

Legal Obligation

We may process or retain information where necessary to comply with legal or regulatory requirements.

This may include obligations relating to:

  • Accounting;
  • Tax;
  • Fraud prevention;
  • Payment regulation;
  • Consumer protection;
  • Data protection;
  • Court orders; and
  • Other legal requirements.

Legitimate Interests

Where permitted by applicable law, we may process information where reasonably necessary for a legitimate business interest and where that interest is not overridden by your rights and interests.

Legitimate interests may include:

  • Protecting the Store from fraud;
  • Maintaining security;
  • Preventing abuse;
  • Maintaining transaction records;
  • Establishing or defending legal claims;
  • Improving Store functionality;
  • Understanding Store performance; and
  • Protecting our intellectual property.

Where required, we will consider the effect of such processing on your privacy rights.

Consent

We rely on consent where applicable law requires it or where we choose consent as the appropriate lawful basis.

This may apply to certain:

  • Marketing communications;
  • Optional cookies;
  • Analytics technologies; or
  • Other voluntary processing activities.

Where processing is based on your consent, you may withdraw that consent at any time.

Withdrawal of consent does not affect the lawfulness of processing that occurred before consent was withdrawn.

Other Lawful Bases

Where applicable law permits, personal data may also be processed on another recognized lawful basis where appropriate to the circumstances.

9. Transactional and Marketing Communications

Transactional Communications

We may send communications that are reasonably necessary to provide services you requested.

These may include:

  • Order confirmations;
  • Payment confirmations;
  • Download links;
  • License documents;
  • Account-security notices;
  • Refund updates;
  • Support messages; and
  • Important information concerning your Order.

These communications are not necessarily marketing communications and may be necessary to perform our contract with you.

Marketing Communications

We may send promotional or marketing communications where you have requested them or where otherwise permitted by applicable law.

Where required, we will obtain your consent before sending marketing communications.

You may unsubscribe from marketing communications using an available unsubscribe mechanism or by contacting support@jebjosh.com.

Unsubscribing from marketing does not prevent us from sending necessary transactional or service-related communications.

10. Sharing and Disclosure of Personal Data

We do not disclose personal data merely for unrelated purposes.

We may share personal data where reasonably necessary with the categories of recipients described below.

Trackdock Limited and Trakroom

The Store uses Trakroom, operated by Trackdock Limited.

Trackdock Limited may process information necessary to provide:

  • Hosting;
  • Customer accounts;
  • Checkout;
  • Order management;
  • Digital delivery;
  • Security;
  • Technical infrastructure; and
  • Other Platform services.

Where Trackdock Limited processes information on our behalf, such processing is performed in connection with providing Platform services.

Where Trackdock Limited independently determines the purposes of particular processing, its own privacy policy may also apply.

Payment Processors

Payment transactions are handled through third-party Payment Processors.

JEBJOSH MEDIA LIMITED does not collect, receive, or store your full card number, CVV, CVC, PIN, or other sensitive card credentials. These details are entered directly into and processed by the applicable Payment Processor's secure payment environment.

We may exchange limited Order and transaction information with Payment Processors where necessary to:

  • Process payments;
  • Match a payment to an Order;
  • Verify transactions;
  • Prevent fraud;
  • Issue refunds;
  • Handle payment disputes;
  • Respond to chargebacks; or
  • Comply with legal and regulatory requirements.

Depending on the processing activity, a Payment Processor may independently determine how payment information is processed and may have its own:

  • Legal obligations;
  • Regulatory obligations;
  • Security requirements;
  • Fraud-prevention procedures; and
  • Privacy practices.

The Payment Processor's own privacy policy and terms apply to its independent processing of payment information.

Hosting, Infrastructure and Storage Providers

Service providers may process information necessary to provide:

  • Web hosting;
  • Cloud infrastructure;
  • Database services;
  • Digital-product storage;
  • File delivery;
  • Backups;
  • Security; and
  • Other technical infrastructure.

Email and Communications Providers

We may use third-party providers to send:

  • Order confirmations;
  • Download links;
  • Account messages;
  • Customer-support communications; and
  • Other Store-related messages.

Professional Advisers

Where reasonably necessary, we may disclose information to professional advisers such as:

  • Lawyers;
  • Accountants;
  • Auditors;
  • Compliance advisers; or
  • Other professional consultants.

Authorities and Legal Requests

We may disclose personal data where we reasonably believe disclosure is necessary to:

  • Comply with applicable law;
  • Comply with a court order;
  • Respond to a lawful regulatory request;
  • Cooperate with a lawful investigation;
  • Protect our rights;
  • Protect customers;
  • Detect or prevent fraud;
  • Protect the security of the Store; or
  • Establish, exercise, or defend a legal claim.

We will not knowingly disclose more personal data than is reasonably necessary for the applicable purpose.

11. Service Providers and Data Processors

We may engage third-party service providers that process personal data in connection with providing services to us.

Where a third party processes personal data solely on our behalf, we seek to use appropriate contractual and organizational arrangements consistent with applicable data-protection requirements.

Service providers are expected to use personal data only for authorized purposes and to apply appropriate safeguards.

However, some third parties may act as independent data controllers for some processing activities because they have their own legal, regulatory, fraud-prevention, security, or operational responsibilities.

Where a third party acts independently, its own privacy policy governs that independent processing.

12. International and Cross-Border Data Transfers

The Store uses internet, cloud, payment, communications, and technology services that may operate in countries outside Nigeria.

As a result, personal data may be processed, stored, accessed, or transferred internationally.

Where personal data is transferred outside Nigeria, we will seek to ensure that the transfer is permitted under applicable Nigerian data-protection law.

Depending on the circumstances, this may involve:

  • A jurisdiction recognized as providing an adequate level of data protection;
  • An approved or legally recognized cross-border data-transfer mechanism;
  • Appropriate contractual safeguards;
  • Technical and organizational safeguards;
  • A transfer necessary to perform a contract or provide a service requested by you;
  • Your explicit consent where consent is an appropriate basis; or
  • Another transfer mechanism permitted by applicable law.

We will consider the nature of the personal data, the purpose of the transfer, the destination, and available safeguards where required.

The fact that a service provider operates outside Nigeria does not remove our obligations concerning personal data for which we remain responsible.

13. Data Security

We take the security of personal data seriously.

We and service providers acting on our behalf use reasonable technical and organizational measures designed to protect personal data against:

  • Unauthorized access;
  • Unauthorized disclosure;
  • Accidental loss;
  • Unlawful processing;
  • Alteration;
  • Destruction;
  • Misuse; and
  • Other reasonably foreseeable security risks.

Measures may include, where appropriate:

  • Access controls;
  • Authentication;
  • Encryption in transit;
  • Secure Payment Processor integrations;
  • Restricted administrative access;
  • Monitoring and logging;
  • Security updates;
  • Backups;
  • Fraud-prevention controls; and
  • Other reasonable technical safeguards.

Payment card information is handled through the applicable Payment Processor rather than being collected or stored directly by JEBJOSH MEDIA LIMITED.

However, no internet transmission, electronic-storage system, or security measure can provide an absolute guarantee against every possible security incident.

You are responsible for taking reasonable steps to protect your own account credentials and devices.

14. Personal Data Breaches and Security Incidents

If we become aware of a personal-data breach affecting information for which we are responsible, we will assess the nature and potential impact of the incident.

Where applicable law requires notification, we will notify the appropriate supervisory authority and/or affected individuals within the period and in the manner required by applicable law.

We may also take steps to:

  • Contain the incident;
  • Protect affected systems;
  • Preserve relevant evidence;
  • Investigate the cause;
  • Reduce potential harm;
  • Restore affected services; and
  • Prevent recurrence.

If you believe your Store account or personal data may have been compromised, contact us promptly at support@jebjosh.com.

15. Data Retention

We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, subject to legal, regulatory, accounting, security, contractual, and dispute-resolution requirements.

Retention periods may vary depending on the type of information.

Order and Transaction Records

We may retain Order and transaction records as necessary to:

  • Demonstrate purchases;
  • Process refunds;
  • Resolve disputes;
  • Respond to chargebacks;
  • Maintain accounting records; and
  • Comply with tax or legal obligations.

License Records

We may retain license information for as long as reasonably necessary to:

  • Verify the License granted;
  • Demonstrate rights obtained through a purchase;
  • Resolve licensing disputes; and
  • Protect the rights of both the Customer and JEBJOSH MEDIA LIMITED.

Because some music licenses may remain relevant for many years after a purchase, related licensing records may need to be retained for an extended period.

Customer-Support Records

Support communications may be retained for a reasonable period where needed to:

  • Resolve an issue;
  • Maintain service history;
  • Protect legal rights; or
  • Demonstrate how a complaint or request was handled.

Marketing Information

Where we rely on your consent to send marketing communications, relevant contact details may be retained until you unsubscribe, withdraw consent, or the information is no longer necessary.

We may retain limited suppression information after an unsubscribe where necessary to ensure that your marketing preference continues to be respected.

Security and Technical Records

Security, access, fraud-prevention, and technical logs may be retained for a reasonable period based on security requirements and legitimate operational needs.

When personal data is no longer required, we will delete, anonymize, or otherwise securely dispose of it where reasonably practicable and legally appropriate.

16. Accuracy of Personal Data

We take reasonable steps to maintain personal data that is accurate and appropriate for the purposes for which it is processed.

You are encouraged to keep information associated with your Store account accurate and up to date.

If you believe information we hold about you is incorrect or incomplete, contact us at support@jebjosh.com.

17. Your Data Protection Rights

Subject to applicable law and any lawful limitations or exemptions, you may have rights concerning your personal data.

Under applicable Nigerian data-protection law, these may include:

Right to Be Informed

You may have the right to receive clear information about how your personal data is collected and processed.

Right of Access

You may request confirmation of whether we process your personal data and, where applicable, request access to that information.

Right to Rectification

You may request correction of inaccurate personal data or completion of incomplete information.

Right to Erasure

Where applicable, you may request deletion of personal data that is no longer lawfully required.

This right may be limited where information must be retained for reasons such as:

  • Legal obligations;
  • Tax or accounting requirements;
  • Fraud prevention;
  • Establishing or defending legal claims;
  • Maintaining evidence of a License; or
  • Other lawful purposes.

Right to Restrict Processing

In circumstances provided by applicable law, you may request that certain processing of your personal data be restricted.

Right to Object

Where applicable, you may object to processing based on certain lawful bases, including some processing based on legitimate interests.

Right to Data Portability

Where applicable, you may request certain personal data in a structured, commonly used, machine-readable format or request its transmission as permitted by law.

Right to Withdraw Consent

Where processing is based on your consent, you may withdraw that consent at any time.

Withdrawal does not affect processing lawfully carried out before withdrawal.

Rights Relating to Automated Decision-Making

Where applicable law provides, you may have rights relating to decisions based solely on automated processing that produce legal or similarly significant effects.

Payment Processors and fraud-prevention services may use automated systems as part of payment authorization and risk assessment and may provide additional information concerning those processes in their own privacy notices.

Right to Complain to a Supervisory Authority

You may have the right to lodge a complaint concerning the processing of your personal data with the Nigeria Data Protection Commission ("NDPC") or another competent data-protection authority.

18. Exercising Your Rights

To exercise a privacy or data-protection right relating to personal data controlled by JEBJOSH MEDIA LIMITED, contact:

support@jebjosh.com

Please provide enough information for us to identify:

  • Who you are;
  • The information or processing your request concerns; and
  • The right you wish to exercise.

We may request reasonable information to verify your identity before disclosing, correcting, deleting, or otherwise acting on personal data.

This is intended to protect personal information from unauthorized access or disclosure.

We will respond to valid requests within the period required by applicable law.

We may refuse or limit a request where applicable law permits or requires us to do so, including where we cannot reasonably verify the identity of the requester or where retaining certain information is legally necessary.

Where a request primarily concerns information controlled independently by Trackdock Limited or a Payment Processor, we may direct you to the appropriate party where necessary.

19. Complaints

If you believe we have not handled your personal data properly, we encourage you to contact us first at support@jebjosh.com so that we can investigate the issue.

Contacting us does not remove any right you may have to lodge a complaint directly with the Nigeria Data Protection Commission ("NDPC") or another competent supervisory authority.

We will cooperate with lawful investigations or requests from competent data-protection authorities as required.

20. Fraud Prevention and Payment Security

We, Trackdock Limited, and Payment Processors may process information to identify, investigate, or prevent:

  • Unauthorized payments;
  • Account abuse;
  • Fraudulent Orders;
  • Stolen payment credentials;
  • Suspicious transactions;
  • Chargeback abuse;
  • Security attacks; and
  • Other unlawful activity.

Information used for fraud prevention may include:

  • Transaction information;
  • Account activity;
  • IP address;
  • Device information;
  • Payment status;
  • Order history;
  • Download activity;
  • Security logs; and
  • Other relevant risk signals.

Sensitive card information used for payment authentication or authorization is handled by the applicable Payment Processor and is not collected or stored directly by JEBJOSH MEDIA LIMITED.

Processing for fraud prevention may be based on legitimate interests, legal obligations, contractual necessity, or another lawful basis depending on the circumstances.

21. Chargebacks and Payment Disputes

If a payment dispute, chargeback, refund investigation, or fraud inquiry arises, we may share relevant information with:

  • The applicable Payment Processor;
  • Acquiring or issuing banks;
  • Card networks;
  • Financial institutions;
  • Trackdock Limited;
  • Fraud-prevention providers; or
  • Other parties reasonably involved in resolving the transaction.

Information provided may include:

  • Order records;
  • Transaction references;
  • Customer information;
  • Product information;
  • License records;
  • Delivery records;
  • Download or access records;
  • Customer communications; and
  • Other evidence relevant to the transaction.

This does not mean that JEBJOSH MEDIA LIMITED holds your full card number, CVV, PIN, or other sensitive payment credentials.

We will seek to limit disclosure to information reasonably necessary for the applicable dispute, investigation, or legal requirement.

22. Business Transfers

If JEBJOSH MEDIA LIMITED is involved in a merger, acquisition, corporate restructuring, financing, sale of assets, or transfer of the business operating Jebjosh, personal data may be disclosed or transferred as part of that transaction where permitted by applicable law.

Where required, appropriate safeguards and notices will be provided.

Any successor receiving personal data will remain subject to applicable data-protection obligations.

23. Links to Third-Party Websites

The Store may contain links to websites or services that are not operated or controlled by JEBJOSH MEDIA LIMITED.

If you follow a third-party link, that third party may collect or process information under its own privacy policy.

We encourage you to review the privacy information provided by third-party websites before providing them with personal data.

We are not responsible for independent processing carried out by third parties whose websites or services we do not control.

24. Children's Privacy

The Store is not directed to persons under the age of 18.

We do not knowingly seek to collect personal data from a person under 18 in circumstances where applicable law requires parental or guardian authorization.

If you are a parent or guardian and believe that a person under 18 has provided personal data through the Store without any authorization required by law, contact us at support@jebjosh.com.

Where we determine that personal data has been collected from a child in circumstances that do not comply with applicable law, we will take appropriate steps concerning that information.

25. Privacy by Design and Data Minimization

Where reasonably practicable, we seek to design our Store operations so that personal data collection is limited to information reasonably necessary for legitimate business and legal purposes.

We seek to avoid collecting personal data merely because it may be technically possible to collect it.

When selecting service providers and implementing Store functionality, we may consider:

  • The amount of personal data involved;
  • The purpose of processing;
  • Security risks;
  • Access controls;
  • Retention needs;
  • Customer privacy;
  • Appropriate technical measures; and
  • Applicable data-protection requirements.

26. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to:

  • Our products;
  • Store functionality;
  • Service providers;
  • Payment methods;
  • Technology;
  • Business practices;
  • Data-processing activities;
  • Legal requirements; or
  • Regulatory guidance.

When this Privacy Policy is updated, the revised version will be published through the Store and the effective or last-updated date may be changed accordingly.

Where an update materially changes how we process personal data and applicable law requires additional notice or consent, we will take appropriate steps.

You should review this Privacy Policy periodically.

27. Relationship With Other Store Policies

This Privacy Policy should be read together with our:

  • Merchant Service Agreement;
  • Terms of Use;
  • Refund & Cancellation Policy; and
